Can You Store Guns and Ammo Together in Massachusetts

The Pinnacle V Myths Nigh Owning a Gun in Massachusetts

Time to Clear Upwardly Some Misconceptions…

When nosotros teach our MA Firearms Safety Courses we get the pleasure of hearing quite a few interesting opinions on what you can and cannot do with a gun in Massachusetts. Some are valid… others, not then much.

Then… We decided to compile the Peak 5 Myths About Owning a Gun in Massachusetts!

Myth #one: Yous Accept to Store Your Gun and Ammo Separately in Your Home

I inquire every single class this question: Tin can you get out a loaded handgun in a safe? Nosotros usually get a varied range of responses, with some folks suggesting that you keep your ammo and gun split up even when locked in a secure container. I aspect this to a processing error when people read that "a firearm must be secured with a trigger lock or cable lock device, or in a rubber or locked container" as people tend to melody out once they  call up that they have read the complete sentence.

No… you don't have to lock your gun upwardly later on y'all detach information technology, take your ammo to your neighbor'south house, and hibernate your firing pin. Merely phase your gun for its intended purpose. My home defense force pistols are staged just for that. Loaded in condition i and staged for dwelling house defence.

Myth #two: If You Defend Yourself With Your Firearm Y'all WILL Go Arrested.

I'm going to put this one as "depends." There are a lot of factors that come in to play when you defend yourself with a firearm. Kickoff and foremost, y'all have to know the laws that arespecific to your country. For instance if yous say Castle Doctrine in Texas, it means a completely different affair than information technology does in Massachusetts.

The lesser line is you take to educate yourself on the appropriate apply of strength rules for your state. The best fashion to do that is to take a Employ of Strength grade such as our Employ of Strength | Habitation Defense force | Curtained Carry Form which will teach you all you demand to know well-nigh using lethal force to protect yourself and your loved ones. Recollect: your goals should be staying alive, and staying out of jail.

Myth #3: Law Chiefs Tin can Deny Anyone a License to Carry for Any Reason… and there's nothing y'all tin can practice about information technology.

Nope. Since the changes in 2022 to the firearms laws in MA you at present have a right of entreatment at theDistrict Court level. This is big every bit  prior to the changes in the laws, you were stuck in the scarlet tape of the Firearms Record Agency and the whole process was a mess. You will either be issued or denied a license within twoscore days. If you are denied, you then take xc days to appeal the denial in the District Court. In order for the District court to uphold the denial it must be plant that:

(A) reliable, articulable, and credible information that the applicant has exhibited or engaged in behavior to suggest the bidder could potentially create a risk to public rubber; or

"(B) existing factors that suggest that the bidder could potentially create a gamble to public safety.

This is adept as it FINALLY puts a standard burden of proof on what supports the denial. This certainly makes owning a gun in Massachusetts a flake easier. More than information tin can exist plant at GOAL.org'due south License Deprival Page.

Myth #iv:  You Can't Open up Carry in Massachusetts. Ever. Period. Finish of Story.

Nope again. In fact, in 2022 the Supreme Judicial Court of Massachusetts actually ruled in our favor in the case of FRB v. Simkin.  In this instance Mr. Simkin was at a medical appointment during which one of the technicians became scared of his lawfully carried firearm, which he disclosed prior to disrobing. Check out what the SJC said:

…we doubtable that the average Massachusetts resident may become "alarmed" on learning that someone other than a police enforcement officer is carrying curtained weapons in his or her presence. Still, Simkin is non responsible for alarm caused to others by his mere conveying of concealed weapons pursuant to a license permitting him to do exactly that. Although the agency claims that Simkin "went out of his manner to prove and inform sure staff members that he was ․ armed," the record indicates otherwise. Simkin concealed his weapons until he was in the examination room and was nigh to disrobe, at which time he notified the medical assistant that he was conveying concealed weapons and was going to secure them, presumably so that she would not exist alarmed. Farther, he had disclosed the fact that he was armed immediately prior to disrobing during a previous visit to the same medical office, albeit to a dissimilar practitioner, and had received no objection to his behavior either during or after the visit. – See more at: http://caselaw.findlaw.com/ma-supreme-judicial-court/1641408.html

While it is not prudent to openly carry a firearm in Massachusetts, or anywhere you can lawfully conceal it for that thing, you certainly can.

That existence said… conceal your shootin' irons. Delight. It will scare the sheep otherwise.

Myth #5: Yous Tin't Buy Ammunition Online and Have it Sent To Massachusetts.

Ha…. My UPS and Fedex delivery drivers will tell you differently based on the amount of ordnance that shows up at my door on the regular.

Echo after me: In that location is no constabulary that prohibits buying ammo online and having information technology sent to a duly licensed person in Massachusetts.

Some vendors have made the decision not to sell to persons in Massachusetts due to previous Attorneys General bringing suits against them for selling the ammo to MA residents. Which was bovine excrement. To my noesis this hasn't happened recently.

Do your research and find out which companies ship to MA.

Do y'all have any other myths you desire debunked? Leave them in the comment box and allow u.s.a. know!
